1. Introduction

Welcome to Bhartiya Real Estate Agent Welfare Union RERA Services (the "Platform"). These Terms & Conditions ("Terms") govern your access to and use of our website, applications and services. By accessing or using the Platform you accept and agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Definitions

  • User: any visitor, client, agent, builder or entity using the Platform.
  • Services: RERA registration, complaints support, documentation, training, welfare membership and related services provided via the Platform.
  • Content: text, images, files, media, data and any material provided by us or users on the Platform.

3. Eligibility

You confirm that you are at least 18 years of age and legally competent to enter into binding contracts under Indian law. Your use of the Platform must not violate any applicable laws or regulations.

4. Registration & Account Security

When you register, you agree to provide accurate, current and complete information. You are responsible for maintaining confidentiality of account credentials and for all activity under your account. Promptly notify us of any unauthorized use.

5. Acceptable Use

You agree not to use the Platform to:

  • Violate laws or third-party rights;
  • Submit fraudulent, deceptive or forged documents;
  • Upload unlawful, defamatory, obscene or infringing content;
  • Use automated scraping tools without prior written consent;
  • Interfere with the Platform's security or infrastructure.

6. Services Description & Disclaimer

We provide guidance and facilitation for RERA registration, legal drafting, complaint registration, training and other real-estate services. The Platform is a facilitator and consultant — not a government or RERA authority. All Services are provided on an "as-is" basis. We do not guarantee outcomes, timelines or approvals from statutory authorities.

7. Fees, Payments & Taxes

Where fees apply, you must pay applicable charges via approved payment methods. Prices exclude GST and other taxes unless stated. We may change fees; changes apply only to future purchases. Refunds (if any) are governed by the service-specific refund policy.

8. Intellectual Property

All intellectual property on the Platform (text, logos, images, code) is owned by or licensed to us. You may not copy, reuse or publish our IP without written permission.

9. User Content

By submitting content to the Platform you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt and publish such content for Platform operations. You warrant you own or have rights to submit such content and it does not infringe third-party rights.

10. Agent & Builder Registration Terms

  1. Eligibility: Agents and builders must satisfy applicable RERA eligibility and documentation requirements of their State RERA.
  2. Document Submission: You must provide true and accurate documents. Submission of forged or misleading documents may lead to suspension or legal action.
  3. Verification & Approval: We assist with submission and compliance. Final registration approvals, timelines and decisions are at the discretion of the relevant State RERA Authority.
  4. Union Membership: Membership of the Bhartiya Real Estate Agent Welfare Union is voluntary and governed by union rules.

11. Complaint Handling under RERA

We provide documentation, filing assistance and tracking for RERA complaints. Our role is limited to facilitation — we do not guarantee outcomes. Users should escalate matters to the appropriate RERA Authority or seek independent legal counsel where necessary.

To raise complaints, contact our Grievance Officer or use the Platform grievance form. We will handle grievances in accordance with the IT (Intermediary) Rules, 2021.

12. Subscription & Training Services

Certain Services (training, premium content, subscriptions) are paid. Subscription details, inclusions and duration are displayed at checkout. Unless otherwise stated, subscription fees are non-refundable. Refund exceptions (duplicate payment, technical fault) may be processed within 7–10 business days after verification.

Certificates are issued after meeting attendance and assessment conditions. Course materials are for personal, non-commercial use only.

13. Data Protection & Privacy

We respect your privacy and implement reasonable technical and organizational safeguards. We collect only required personal data (name, contact, documents) to provide Services and to comply with statutory requirements (including sharing with RERA offices when necessary).

15. Limitation of Liability & Indemnity

Limitation: To the extent permitted by law, we (and our affiliates, officers, employees) shall not be liable for indirect, incidental, special or consequential damages arising from the use of the Platform.

Indemnity: You agree to indemnify, defend and hold us harmless from and against any claims, losses, liabilities or costs arising out of your use of the Platform or breach of these Terms.

16. Termination

We may suspend or terminate access at our sole discretion for violations of these Terms or illegal activity. On termination, your rights to use the Platform cease immediately.

17. Changes to Terms

We may amend these Terms from time to time. Updated Terms will be posted on this page with an updated "Last Updated" date. Continued use after changes constitutes acceptance.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Nagpur, Maharashtra, unless otherwise agreed in writing.
